Open Internet Preservation Act Seeks To Stop Internet Censorship & Promote Free Flow Of Information


Congress in both the House and the Senate are moving to protect the Internet from the hands of the Federal government; viz., the Federal Communication Commission (FCC) bureaucracy making law rather than Congress. All bureaucratic rules touted as Federal law should be verified by Congress before it has the force of law.

 

The legislation would not only take a politicized FCC out of the Internet, but would keep some of good parts of the Net Neutrality issues such as preventing ISP blocking or slowing data streaming of companies or ideologies out of favor of the an ISP owner.

Rep. Marsha Blackburn (R-TN) has introduced HR4682, the Open Internet Preservation Act, in the House of Representatives, along with 21 co-sponsors.

 

The bill, which was referred to the House Committee on Energy and Commerce near the end of December, seeks to “amend the Communications Act of 1934 to ensure internet openness, to prohibit blocking of lawful content, applications, services, and non-harmful devices, to prohibit impairment or degradation of lawful internet traffic, to limit the authority of the Federal Communications Commission and to preempt State law with respect to internet openness obligations, to provide that broadband internet access service shall be considered to be an information service, and for other purposes.”

 

This legislation begins to address the growing threat by corporate giants, not just broadband services that are seeking to eliminate anything by the state-controlled message to the masses rather than allowing the internet to be a free flow of information.

 

“The Open Internet Preservation Act will ensure the internet is a free and open space,” said Rep. Blackburn, chairman of the House Energy and Commerce Communications and Technology Subcommittee.

 

“This legislation is simple, it provides light-touch regulation so companies can invest and innovate, and makes sure our internet is up to 21st century standards,” she added.

 

Blackburn’s bill was introduced on December 19, 2017 and came just one week after the Federal Communications Commission (FCC) repealed the 2015 Title II regulations under the Communications Act of 1934, the so-called net neutrality rules.

 

The repealed regulations classified broadband internet as a utility-like tool for communication. It will now be categorized as an information service, which is what it is.

 

However, the repeal removes bans on throttling, blocking and paid prioritization, as well as on how much data companies would have to report.

 

So, Rep. Blackburn’s bill would seek to restore some of those newly adopted regulations, but not all of them.

 

Among the things HR 4682 would restore are two provisions of the net neutrality.  It bans both blocking and throttling while not including a ban on paid prioritization.

 

Blackburn sought to block the implementation of Net Neutrality in several congresses she served in.

 

In the 112th, 113th and 114th Congress, Blackburn introduced the Internet Freedom Act, legislation that would block the FCC’s Net Neutrality rules by stating that they shall have no force or effect and prohibits the FCC from reissuing new Net Neutrality rules.

 

In 2016, the Senate introduced a companion to Blackburn’s bill, S. 2602. The bill was introduced by Senator Mike Lee (R-UT). Co-sponsors included Senators Marco Rubio (R-FL), Ted Cruz (R-TX), Rand Paul (R-KY), Tom Cotton (R-AR), Thom Tillis (R-NC), John Cornyn (R-TX), and Benjamin Sasse (R-NE).

 

“We must stop the FCC’s Net Neutrality rules, which are nothing more than a Trojan horse for government takeover of the Internet,” rep. Blackburn said.  “These overreaching rules will stifle innovation, restrict freedoms, and lead to billions of dollars in new fees and taxes for American consumers. We thank Senator Lee for introducing the Senate version and look forward to working with him as we move this forward.”

 

“The economic burden of these regulations will fall squarely on the backs of the consumers the FCC purports to help,” Senator Lee said.  “The threat of anticompetitive behavior should always be taken seriously. But it makes no sense for a five-person panel of presidential appointees to write a sweeping law aimed at solving a problem that might someday exist. There are more effective, more democratic, and less intrusive ways to address anticompetitive behavior, including existing antitrust and consumer-protection laws.”

 

Blackburn commended Ajit Pai for his getting net neutrality rules repealed and said that he “had done his job.”

 

Rep. Stivers, who co-sponsored the bill, said of the legislation, “Bottom line: Free and open internet should never be a partisan issue.  This bill would put into law crucial consumer protections that millions of Americans have asked for and that are emphasized in the principles of net neutrality.”

 

He added that the bill did just that “without imposing the burdensome and overly broad aspects that were originally designed for the rotary telephone on the cultural and economic engine that is our modern internet.”

Federal Communications Commission is going to vote on it February 26th. That’s why I am writing you today–I need your help to stop this.

President Obama came out a few weeks ago urging the FCC to vote to regulate the Internet the same way that it regulates public utilities under Title II. What this means is that, for the first time, billions of dollars in fees will be attached to Internet service just like they are to telephone service.

You see, under Title II if someone wants to own a telephone company, there are fees baked into the law–fees companies pass on to customers.

Now, under this new regulatory regime, Internet service providers will be subject to these fees as well, and then pass them on to you, the consumer.

This is essentially a massive tax increase on the middle class, being passed in the dead of night without the American public really being made aware of what is going on.

The Internet is built on speed and dynamism, it’s always changing, there are always new and better ideas that are exploding onto the scene, and part of the reason for that is that innovators are not having to go ask Washington, DC for permission every time they want to do something new.

What this really comes down to is a fundamental question:

 
Who do you want in charge of the direction of the Internet: people at dot-com startups that brought us game changing companies like Facebook, Google, Twitter, Amazon and Uber; or nameless, faceless, unelected bureaucrats in our nation’s capital?
 
There is another aspect of this that gets overlooked: the Internet is an incredibly important force for freedom, for liberty, and the rights of free speech that we hold dear. It is an existential threat to tyrants in countries like Iran, Saudi Arabia, and Russia who seek to keep information from their people.

We must preserve the high ground for the United States to stand up to these countries and tell them to keep the Internet free and preserve free speech on the Internet throughout the world. We cannot do that if we are regulating the Internet in a similar manner ourselves.

I am not accusing anyone of sinister motives here, but I am deeply concerned about the idea of any government bureaucrat having the power to tell companies what they can and cannot do. In the long term, this could have a chilling effect on political speech, in ways that today we could not even begin to imagine.

We do not have much time left to stop this gigantic government takeover of the Internet. The FCC is voting on February 26th and the Left is mobilizing to support their effort to do so. We cannot let the conversation be totally one-sided. The FCC needs to hear from us today–not tomorrow or next week or next month. Today.


Please join me and go sign the petition to keep the Internet free. We must stand for liberty and preserve the Internet free of government interference.

If not then enjoy the read. To offer some full disclosure, Tony sent some info on April 1 that I am not quite sure on how to process. He found an article dated in 2011 that points a finger at Republican Darrel Issa – Chairman of the Oversight Committee in the House – as conspiring to use insider trading in connection to Goldman Sachs at a huge stock trading company. Currently Rep. Issa is a bit of a hero of mine for not taking guff from Dems, Obama, State Department, CIA and members of the military as it relates to uncovering the truth about Benghazigate.

After fending off numerous attacks on the freedom of the internet last year, activists and independent journalists alike are now facing another hurdle that flies in the face of freedom of the press, the “Journalist Shield Law“.

 

Although the bill is being sold by the Obama administration and establishment politicians in both parties as a positive step in protecting free speech, unfortunately the name of this bill is highly deceiving. Remembering just how unpatriotic the Patriot Act was, this new law, although deceivingly named, is likely to crush freedom of speech of any journalist not on a corporate payroll. According to the AP, this is how the bill defines who a real journalist is:

 

“The bill’s protections would apply to a “covered journalist,” defined as an employee, independent contractor or agent of an entity that disseminates news or information. The individual would have to have been employed for one year within the last 20 or three months within the last five years.

 

It would apply to student journalists or someone with a considerable amount of freelance work in the last five years. A federal judge also would have the discretion to declare an individual a “covered journalist” who would be granted the privileges of the law.”

 

Essentially, if you don’t work for the likes of the dying mainstream media, the government can (and will) subpoena any journalist to force them to reveal their sources or face prosecution. Apparently, as described by one of the nation’s biggest hypocrites, the First Amendment only applies to some people and the government should get to decide who those people are.  According to the bill, any information that “in purpose, subject matter and period of time covered so as to avoid compelling disclosure of peripheral, nonessential or speculative information.” could potentially be subject to Big Brother’s sticky fingers. Both parties and both houses of Congress hated the disclosure portion of the law so much that it was repealed on Friday without debate—the measure was sent to the president by unanimous consent. The STOCK Act would have required members of Congress, their aides, and other federal employees making more than $119,554 a year to disclose their financial dealings in an online database. Once again President Obama is putting you and your family at risk by giving power to the United Nations (UN) to control the Internet and muzzle YOUR freedom of speech, putting you at a risk of legal action just for expressing your view on the Internet.

If you’re a politician in Washington, and you want to bury bad news, you release an announcement late on Friday afternoon.

On Friday, March 14th, at 3:30pm, the Obama administration announced that America was surrendering control to the UN over key aspects of the Internet (control that America had because we built it in the first place).

Unfortunately, the largest voting bloc in the UN is the Organization for Islamic Cooperation (OIC), a Saudi-dominated bloc of 57 nations that has waged an aggressive campaign against free speech, freedom of the press and free expression.

For an American president to betray the American public, our founding fathers, our Constitution, and throw our freedom of speech at the feet of tyrants to decide what we can and cannot say under the threat of a law suit for hate crime is unconscionable – shameful – reckless and stretches the boundaries of betrayal.

Our founding fathers are turning in their grave.

Let us never forget all that our founding fathers sacrificed so that we can enjoy the democratic freedoms we have today. Let us not forget how so many of them gave their lives for this and that many of them died destitute. They were willing to give everything they had. We cannot let them down. We must stand up, fight this, and inform Americans about what our president has just done. Barbaric regimes from Khartoum to Tehran, and Damascus to Riyadh, have cut off their own citizens’ Internet access in the past, but they have been unable to undermine general access to the Internet, where no one needs any government’s permission to launch a website. This hallmark of Internet freedom is now endangered.

Dictators and tyrants, who have always silenced their critics and suppressed independent media, have long had a goal of “international” control over the Internet. Now the stage is set for them to achieve that goal.

UN members have called for a UN agency called the International Telecommunication Union (ITU) to replace America’s authority and challenge an open Internet. One critic calls the ITU “the chosen vehicle for regimes for whom the free and open Internet is seen as an existential threat.”

According to the Wall Street Journal, many UN member-nations want the ITU to outlaw anonymity on the Web (which would make it easier to identify dissidents) and to add a fee charged to providers when people gain access to the Web “internationally.” This, in effect, would create a tax on U.S.-based sites such as Google and Facebook. The unspoken aim is to discourage global Internet companies from giving everyone equal access.

The NSA is spying unconstitutionally against Americans! I am outraged, are you? There are tech measures to take to try an end run around NSA snooping until either Congress or Supreme Court set things Constitutionally right.

 

The article I read concerning these counter measures claims the terrorists of the world already know them. That makes sense to me; however I am guessing in this age of super-secret technology that the NSA has counter measures for the counter measures.

 

Anyway if you wish to throw a monkey wrench into the Big Brother U.S. government spying on you unconstitutionally read the article and see what you can do. I myself have little to hide and so I am not inclined to find the funds to have to fool my government about my private life. On the other hand if Big Brother starts to politically persecute little insignificant me who is not a mover and shaker, then I might change my mind and make greater efforts to guard my privacy against Big Brother.

How to Keep Your Info Private (Even From the NSA)

Thwarting the efforts of a billion-dollar super-secret government spy agency — or anyone else who wants access to your personal information — is not that difficult.

 

With the recent revelations that the NSA and other agencies have been tapping into corporate streams of data that can provide them with massive amounts of private information about U.S. citizens, now is a good time to start thinking about how best to keep your private information private.

 

Not a big deal, you say? Well, whether you’re concerned about the government digging through your personal data or not, you should be concerned about protecting your privacy. According to the Department of Justice’s most recent National Crime Victimization Survey, “In 2010, 7 percent of households in the United States, or about 8.6 million households, had at least one member age 12 or older who experienced one or more types of identity theft victimization.” That’s almost one in 10, with 76 percent of them experiencing direct financial loss as a result.

 

Imagine that statistic was for bank robberies or home break-ins. If 1 in 10 Americans had their bank accounts emptied or their home broken into, we’d all be living in fear. And yet, that’s happening every year to our personal information. Making that information harder for someone else to obtain is Step One in preventing identity theft.

 

And not all identity theft is of the “crime” variety. There’s a famous quote that I’m paraphrasing: “If you’re using a website and you can’t figure out what they’re selling, you’re what they’re selling.”

 

Many corporations make a living off of selling or processing your personal habits and preferences for marketers, retailers and government agencies, practically without your knowledge. Since you’re not being paid for this information, and (unless you speak legalese and love spending your afternoons reading “Terms and Conditions”) you’re not aware that it’s being taken and used in this fashion, I’d consider it “theft.” But since the government has yet to agree with me, the best way to prevent yourself being used in this fashion is to get a little more serious about your privacy.

 

In this article, we’ll focus on the things the NSA has reportedly been looking at. It’s reasonable to assume that if you can stop them from taking a peek at your private information, you’ll have stopped hackers and others, too. Fortunately, thwarting the efforts of a billion-dollar super-secret government spy agency is not that difficult. You just need to know which services to turn to.

 

It’s important to note that everything in this article is public knowledge. If you’re worried about terrorists reading it and figuring out how to thwart our government’s best efforts at finding them, don’t be. The terrorists already know this stuff. You, however, might not

.

1. Your phone

 

If you’re looking to keep SMS messages secure and you have an iPhone, there’s a free app called Wickr that can help. The app uses end-to-end encryption without storing the keys for decryption on its servers. What that means is that when you send a message to someone else using Wickr, nothing you say can be read by anyone at Wickr. Because of that, there’s no stream of plain text messages going back and forth that the NSA or anyone else can siphon.

 

To make voice calls, the easiest option is Silent Circle, but you’re going to have to pay for the privilege — $20 to $29 per month to call other Silent Circle users, with an optional add-on to safeguard calls to everyone else. Joining Silent Circle also gets you secure chat, email and video calling.

 

If you’re an Android user, you have a few more options than iPhone users do. For text messages, there’s Gibberbot. Like Wickr, Gibberbot is free and promises more secure messaging.

 

And for calls, check out RedPhone. When calling someone who also has RedPhone, everything you say is encrypted, making it much more difficult for someone to listen in. Plus, it’s free and uses your data connection, not your cellular voice. So not only will your calls be secure, you won’t have to pay for the minutes either.

2. Your Dropbox

 

According to documents released by The Guardian and The Washington Post, Dropbox is “coming soon” to the NSA’s spy program. If that were to happen, documents, tax records or other private information in your Dropbox folder could be subject to government monitoring. Add to that Dropbox suffering security breaches in the past, and they’re just not safe enough for me. The solution? SpiderOak.

 

SpiderOak is just like Dropbox — there’s a folder, you put stuff in it, that folder syncs between computers and devices — but with one important difference: good encryption. Everything you put in your SpiderOak Hive (that’s what they call their syncing folder) is first encrypted on your computer using your password, then sent to the SpiderOak servers.

 

This means that even SpiderOak can’t read your data without your password; it looks like gibberish. So if someone (the NSA, a foreign government, or a hacker in Latvia) manages to get into SpiderOak’s servers, they won’t be able to see what you’ve stored there without breaking one of the world’s most advanced encryption algorithms (one the NSA trusts to secure its own data).

 

But SpiderOak can also back up any file or folder on your computer, sync any file or folder on your computer, and share any file or folder on your computer. This makes it a great one-stop-shop for all your syncing, sharing and backup needs.

 

There’s a free plan that offers 2 GB of data, plenty for storing tax returns, scans of important documents, photos, small videos, and other data that you would prefer was stored securely. If you need more space, they offer it for a fee. Prices are almost identical to Dropbox, starting at $10 for 100 GB.

 

3. Your social network

 

Unfortunately, there’s no good option here. You join social networks because you want to share things with others, or connect with people you know and see what they’re sharing. Typically, this includes things that you might use as password reset reminders on other sites: a pet’s name, your mother’s name, high school you attended, favorite sports team, etc. That means that if a hacker or the NSA can gain access to your social media profile (either directly with your password, or indirectly by pretending to be someone you know and friending you), they can probably find enough information to gain access to your accounts on other sites, as well.

 

While there are a few start-up social networks that offer more advanced encryption of your data, they’re complicated to install, and even more difficult to get everyone you know using them, too. For now, the best option is to assume that anything you post on Facebook, Google+, Twitter, Pinterest, etc., will eventually be read by everyone in the world. That way, it won’t matter much if someone gets access to your data, be that a government agency, a jilted ex-girlfriend, or simply a prospective or current employer.

 

To share more securely, use something like SpiderOak or a secure messaging program to share directly with those you trust.

 

4. Your credit cards

 

Yes, the NSA is probably looking at credit card transactions, too. So how do you get around exposing your purchase history? “I already know this; the answer is to use cash,” you’re probably thinking. But how do you shop online without using a credit card?

 

The answer, sort of, is Bitcoin. It’s a virtual currency (you give or receive Bitcoins, which are worth something in dollars), but if used correctly, it can provide almost complete anonymity when shopping online. And since you’re not typing your credit card information into a site that may or may not keep that data secure, there’s no risk that your account will be stolen by someone hacking the site.

 

The only catch is that there aren’t a lot of places that accept Bitcoins. In fact, you’d be hard-pressed to find ones that do. But if the currency takes off, it could become the “cash” of the Internet.

 

A more doable option? Buy prepaid gift cards from Visa, MasterCard or American Express with cash. Then use those to shop online. You’ll probably have to pay a few dollars extra when buying the card, but afterward you’ll be able to shop anywhere those cards are accepted without having the purchase data and your identification forwarded to a government agency. If the site where you used the card is ever hacked, you’ve got nothing to worry; by that time you’ll probably have already used the balance on the card and moved on to one with a different number.

 

5. Your Web history

 

Everything you search for on Google, and a good deal of your browsing activity, can also be snooped on by the NSA, according to news reports. The problem is your IP address. It’s the sequence of numbers that identifies your computer on the Internet, and can be traced back to you through your ISP (Internet service provider).

 

The answer? A virtual private network, or VPN. A VPN will sit between you and the websites you visit, encrypting and relaying information back and forth. So when you do a search on Google, the IP address Google records as having performed the search is that of the VPN, not you. Find a good VPN, one that’s easy to use, with a good price, limited or no logging of your activity and fast speed, and you’ll be much harder to track online. Just make sure you sign out of your Google, Facebook, and Twitter accounts before connecting to the VPN, or use your web browser’s private mode.

 

Here’s a list of VPNs to consider. If you just want me to pick one for you, check out IPVanish.com. They have software that makes them especially easy to use, can be set up on your computer, tablet or smartphone, have servers all over the world that you can connect to, and cost $10 for unlimited use (and it’s even cheaper if you pay for a year in advance).

 

Bonus: Some VPNs accept Bitcoin as payment, making for the ultimate in anonymous Web browsing. Not even the VPN has to know who you are.

While using a VPN at home is something you might consider to protect your privacy from the NSA, using a VPN at a public Wi-Fi hot spot or hotel network should be mandatory. Often, those networks are unsecured and almost everything you do can be “sniffed” out of the air by someone else connected to the same network. A VPN would protect you.

 

6. Your everything else

 

While I’ve tried to hit all the major areas you might want to protect, this is by no means a comprehensive list of everything you can do to keep your private information safe and secure. Entire websites could be devoted to the topic.

 

Websites like Security In-A-Box. They’ll teach you everything from creating good passwords and protecting your computer from hackers to remaining anonymous online and bypassing censorship.
