Against the National Will

By Justin O. Smith

America is made less safe through Leftist immigration policy, as evidenced over the last eight years. Illegal aliens rob, rape and murder millions of Americans each year, because Leftist activist judges have said these illegals have “a right” to simply appear in our country, and Leftist mayors of U.S. cities refuse to enforce sound and logical U.S. immigration law already in existence, creating “sanctuary cities”. Their combined anti-American actions are directly responsible for so much misery, loss and heartache for American citizens they have sworn an oath to protect, and they have placed our U.S. national sovereignty in jeopardy.

Too many Americans blindly accept the fallacies and outright lies from the Left, that illegal aliens have “a right” to self-immigrate and a “birthright” to U.S. citizenship for any of their children born in America. These are weapons that Leftist judges use in their rulings to undermine our U.S. Constitution and move closer to an open border policy intent on fundamentally transforming our culture and society and ending American traditions, based on equality under the law, that preserve freedom and liberty for all Americans.

Whenever anyone witnesses Leftist protests from Sacramento to Seattle and New York to Atlanta, or points in between, LARAZA [FrontPageMag, DTN & Human Events] and Red Communist flags, the Hammer and Sickle, are readily seen everywhere, along with the black flag of the Islamic State. These people — all of them — in one form or fashion seek the fall of America and the eradication of our current U.S. Constitution, and as such, they indicate that they are outside the jurisdiction of the U.S., that their allegiances lie elsewhere rather than with the United States of America.

The author of the 14th Amendment, Senator Jacob Howard, defined who fell within the jurisdiction of the United States: “Every person born within the limits of the United States, and subject to [the states’] jurisdiction, is by virtue of natural and national law, a citizen of the United States. This will not, of course, include persons born in the [U.S.] who are foreigners [and] aliens …”. Pointing to natural law indicates the republican basis for citizenship is consent of the country.

On May 30th, 1866, Senator Lyman Trumbull stated that the jurisdiction clause includes those “not owing allegiance to anybody else … It’s only those persons … that we think of making citizens; and there can be no objection to the proposition that such persons should be made citizens.

Read deeper in the Congressional Record of the day [NationalPublicLibrary.com & Justia.com (note 1268)], and one finds that most Congressmen intended “jurisdiction” to be viewed in the context of “in extent and quality as it applies to every citizen of the United States now” and “in every respect”. They also agreed that high crimes and treason could be used as grounds to revoke one’s citizenship.

Approximately 118 jurisdictions in the United States currently serve as sanctuaries for dangerous illegal aliens. Immigration and Customs Enforcement reported that 279 counties and cities refused to detain and deport illegal aliens last year, even though a high percentage of them were Unaccompanied Alien Children who were violent gang members of MS-13.

Recently, a 14 year old girl was raped and sodomized repeatedly by two Unaccompanied Alien “Children”, who pulled her into a bathroom at Rockville High School in Montgomery County, Maryland, a sanctuary area for illegal aliens. One of her attackers, Henry Sanchez, an 18 year old Guatemalan, has a pending deportation case against him; both he and 17 year old Jose Montano, from El Salvador, were charged with first degree rape.

Hesham Mohamed Hadayet came to America on a tourist visa and immediately applied for asylum due to persecution in Egypt. They were “persecuting” him, because he was a member of Gama’a Islamiyya, an Islamic terrorist group. But thanks to Barney Frank’s 1989 amendment to the Immigration and Naturalization Act, he couldn’t be blocked from coming to America.

In 2011, the Department of Homeland Security acknowledged they had lost track of millions of people overstaying their visas. Two years later, they lost track of 266 dangerous foreigners that posed “national security or public safety concerns”, according to the Director of Homeland Security.

Are these the type of people Americans really wish to give U.S. citizenship? Citizenship is a privilege, not a right as some Leftist judges assert.

In a statement on March 27th, 2017, Attorney General Jeff Sessions warned sanctuary cities across America to enforce U.S. immigration law and cooperate with federal authorities or lose federal funding. He made it clear that any failure to correct violations of 8 U.S.C. Section 1373 could result in the termination of all future Office of Justice grants. Sessions added that Kate Steinle’s murder in San Francisco two years ago, by an illegal alien, was a direct result of San Francisco’s policy of refusing to honor federal detainer warrants.

Denying anyone entry into the country, especially for security concerns, is the sovereign right of our nation. The rulings from U.S. District judges such as James Robart, Leonie Brinkema and Dolly Gee, [GOPTheDailyDose.com & AFA.net] as well as upcoming ACLU lawsuits aimed at Jeff Sessions announcement, that suggest otherwise have absolutely no basis in the Constitution or the U.S. legal code; an affirmative legal right for any foreigner to immigrate to America does not exist, but the legal system is being manipulated to create a default “right” to immigrate, damaging our sovereignty and infringing upon our right to self-government, in the name of open borders.

Detailed in government statistics, twenty-five people are killed each day in America by illegal aliens. What is the affirmative case for such an insane policy? How does it make America better?

The current federal court systems have taken the very same laws used by every other president, and they have made them seem anomalous, unConstitutional, even illegal, when President Trump attempts to use them. These courts are overreaching their powers and abrogating the Constitution, when they allow illegal aliens and Muslims, outside the bounds of accurate security assessments, to remain in the country against the national will.

Illegal immigration is not a victimless crime, but Commie Progressive Democrats seem to be more concerned with protecting the rights of illegal aliens from Central America and the Middle East more than they care to protect the person, rights and life of any U.S. citizen. They would rather protect the privileges of well-connected elitists and LARAZA, ACLU commies and Muslim Brotherhood [CAIR] terrorists. But what about the right of a teenage girl to be protected from being raped by illegal aliens — the rights of millions of Americans to be protected from being maimed and murdered by the Sons of Mohammed?

No American who loves his country can allow this total disregard for our Constitution to stand. The President and Congress must forcefully and definitively squash the Courts’ power over this issue and remove their inordinate power. Otherwise, America will become unrecognizable, a mere shadow of Her former glory.

Deadly Consequences

By Justin O. Smith

Sent: 7/10/2015 9:56 PM

Kate Steinle’s murder was one terrible tragedy in a sea of thousands that are committed each year by criminal illegal aliens, who are too often gang members. And her death is especially sad and tragic, because it was so unnecessary and preventable, if only San Francisco had not been a sanctuary city, allowing illegals to come and go as they pleased; Kate’s murderer had already been deported five previous times.

In the days that followed, the Associated Press reported on several more murders by illegal aliens: On July 2nd, Traci Lemley and Jeremy Carrico were murdered in San Antonio, TX by the Mexican Mafia; Jose Valenzuela was charged with the murders of Michael Carrecia and his wife; on July 3rd, Juan Ramirez, an illegal alien in Washington state, was charged with the murder of an 18 year old young lady and her baby boy, setting them on fire; on July 4th, a Haitian “voodoo priest” was arrested for child rape in Florida.

And, while individual murders are a horror unto themselves, there also is an evident national security concern regarding Islamic illegal aliens, such as Mohamed Mamdouh, who plotted to detonate explosives in Manhattan synagogues in 2011. He subsequently pleaded guilty to three charges and received a five year prison sentence.

In 2009, Steve Camarota, from the Center for Immigration Studies, found that 22% of felons in Maricopa County, Arizona were illegal aliens. He also observed that 43 of the 76 fugitive murders most wanted by the FBI were foreign born at the time.

As Judicial Watch reported in 2014, 61,529 criminal cases were initiated by federal prosecutors, with 40% or 24,746 having been filed in court districts near the Mexican border. 12,123 were violent crimes.

Statistics from the state of California show that 95% of murder warrants in Los Angeles are for illegal aliens. 75% of the people on Los Angele’s most wanted list are illegal aliens. 25% of all California’s prisoners are Mexican nationals here illegally; and on a related note, 29% of inmates in federal prisons are illegal aliens. [Potential Source Confirmation HERE and HERE]

In 2010, New York state prisons held more than 4,000 inmates from ten Latin American and Caribbean nations and fewer than 150 from Western European nations.

These statistics should not surprise anyone, since Hispanics now outnumber whites in California and New Mexico. Hispanics are now the largest minority group in 21 other states, including New York, Massachusetts, Texas, Oregon and Wyoming.

A great deal of our current crisis centering on illegal aliens stems from a lack of political will to catch and deport the illegals in Progressive majority states, and while past administrations have been less than diligent in this regard, the Obama administration has laid out the welcome mat for illegal aliens. His lead has indicated to sanctuary cities like San Francisco that they can facilitate catch and release as policy and refuse to cooperate with federal immigration authorities.

The Center for Immigration Studies released a map, on July 8th, of more than 200 sanctuary cities that span the U.S. These areas maintain policies, regulations, executive orders and laws they use to rebuff federal immigration law enforcement authorities and federal law, that authorizes U.S. Immigration and Customs Enforcement to administratively deport illegal aliens without seeking criminal warrants or convictions from any court.

[CIS Sanctuary City Map]

Jessica Vaughn, CIS director of policy studies, said the number of sanctuary cities “might be closer to 300”, if one includes jurisdictions that provide welfare benefits, public housing, driver’s licenses or municipal ID cards.

The list of sanctuary cities includes Miami, FL _ Ann Arbor and Detroit, MI _ Denver, Fort Collins and Durango, CO _ Northampton, Springfield and Chelsea, MA _ and Phoenix, Mesa and Tucson, AZ. Virtually every major city in California, Minnesota, New Jersey, New Mexico, New York, North Carolina, Oregon and Texas are included, along with, of all places, Jackson Hole, Wyoming and Washington, D.C.

It is surreal to now witness Hillary Clinton and Senators Barbara Boxer (CA) and Dianne Feinstein (CA) joining Donald Trump and other Republicans in condemnation of sanctuary policies. They have staunchly defended the right of cities to implement these catch-and-release policies in the past. And now, in a fit of hypocrisy, Sen. Feinstein recently stated, “The tragic death of MS Steinle could have been avoided if the Sheriff’s Department had notified ICE prior to the release of Sanchez, which would have allowed ICE to remove him from the country.”

MS Kathryn Steinle would still be alive today, if only the San Francisco Sheriff’s Department had done the right thing and called ICE. They didn’t need a warrant for pot or anything else in order to make that call and hold Sanchez until ICE could assume custody. All they needed was the fact that he crossed our border illegally. One phone call and Jim Steinle would be hugging a living, breathing young lady, rather than having to bury her on July 9th.

When questioned by an NBC Bay Area reporter, about San Francisco’s sanctuary policies and whether or not Mayor Ed Lee and San Francisco Sheriff Ross Mirkarimi bore some responsibility for her daughter Kate’s death, Liz Sullivan said, “It would have been so much better if he [Sanchez] were gone. Absolutely.”

Now, Mayor Ed Lee, who championed San Francisco’s sanctuary ordinance when it was introduced in 2013, is bowing to the pressure, stating on Wednesday (the 8th) that he would speak to federal officials about participating in a new Obama administration deportation program.

[Blog Editor: I hate doing this to the flow of Justin’s erudite flow of Obama’s horrific agenda with illegal aliens in the USA, but I did some reading in conjunction SF Mayor Ed Lee would revise SF’s sanctuary city policy to participate in the “new Obama administration deportation program.” The Mayor’s so-called new direction will provide little comfort to the victims of illegal alien committed crimes. Check out these excerpts to show my point:

A series of legal setbacks have halted the government’s intensive preparations to move forward with President Obama’s executive actions shielding millions of illegal immigrants from deportation, even as community organizations continue a rapid push to get ready for the programs, according to U.S. officials and immigrant advocacy groups.

Since a federal judge first blocked the new programs in February, the Department of Homeland Security has suspended plans to ….

Yet inside and outside the Beltway, community groups are mobilizing, educating immigrants and training volunteers to help them apply for relief, even though it remains unclear whether the program will ever begin. Most recently, a foundation headed by billionaire George Soros, undaunted by the court rulings, pledged at least $8 million to that effort.

Obama announced in November that up to 5 million illegal immigrants would be eligible to be shielded from deportation — including undocumented parents of U.S. citizens and legal permanent residents — as long as they met certain criteria. … (Obama administration stops work on immigrant program; By Jerry Markon; WaPo; 6/7/15)

And from Allen West:

Within the past month, we’ve brought to your attention the release of some 3,700 “Threat Level One” illegal immigrants. We also shared — on Fox News’ “On the Record” with Greta von Susteren — the case of some 121 released illegal immigrants who’ve committed murders. … Now we learn even more about the fundamental transformation of America — perhaps we should be less concerned about n-words and Confederate flags.

As reported by the Washington Times:

The administration has ordered agents to begin ignoring many of the illegal immigrants they encounter in prisons and jails, as President Obama begins to implement a lesser-known part of his deportation amnesty policy — though his program isn’t sitting well with either side of the immigration debate.

In a nod to so-called sanctuary cities, the president’s policy prohibits U.S. Immigration and Customs Enforcement agents from targeting most illegal immigrants for deportation, including most of those who come into contact with state and local police.

Agents can still troll jails and prisons, but are told to no longer go after illegal immigrants with offenses such as drug possession, theft or fraud if it involved stealing an identity to try to further their unlawful presences in the U.S., according to details of the policy released Tuesday by the House Judiciary Committee.

First of all, President Obama’s claim that criminal illegal immigrants would be priority for deportations appears to be false. Secondly, any city or county not complying with our constitutional republic’s rule of law shouldn’t receive federal funding. It’s unconscionable that we have these violations of our statutes — …

Even some illegal immigrants who’ve been charged with serious felonies but are released by local authorities won’t be picked up by immigration agents until they’re actually convicted, the committee said.

Here’s what happens under Obama’s Priority Enforcement Program (PEP):

Under the program, agents will ignore many of the illegal immigrants they encounter and will change the type of cooperation they request from state and local police. Agents generally won’t ask a department to hold an immigrant who otherwise would be released, but instead will ask to be notified so they can be on hand for the release and have the immigrant transferred.

In limited instances, agents will still issue detainer requests, but will have to assert probable cause so police have a reason to detain people beyond their normal release dates.

“ICE will only seek transfer of individuals in state and local custody in specific, limited circumstances. ICE will only issue a detainer where an individual fits within DHS’s narrower enforcement priorities and ICE has probable cause that the individual is removable,” the agency said in a brochure describing the program. “In many cases, rather than issue a detainer, ICE will instead request notification (at least 48 hours, if possible) of when an individual is to be released. ICE will use this time to determine whether there is probable cause to conclude that the individual is removable.” (How come nobody seems to care about Obama’s latest illegal immigration move? By Allen West; AllenBWest.com; 6/24/15)

Hmm… Mayor Ed Lee, I can’t see how participating in the “new Obama administration deportation program” would have prevented the murder of Kate Steinle by illegal alien Juan Francisco Lopez-Sanchez with a criminal past would have been prevented.]

Donald Trump is absolutely right when he states: “When Mexico sends its people, they’re not sending their best … They’re sending people that have lots of problems, and they’re bringing those problems to us. They’re bringing drugs. They’re bringing crime. They’re rapists. And some, I assume, are good people.”

Americans must demand an end to sanctuary cities and the catch-and-release policies that have such deadly consequences. Americans must demand an end to Obama’s open borders policies that come with too high a cost. Americans must demand the enforcement of existing immigration laws and the deportation of those caught here illegally. Americans must demand secure borders and a stop to the murders of our innocent citizens like Kate Steinle, whose family will love her and sorely miss her from this day on.

The Death of America

By Justin O. Smith

6/28/2014 10:19 PM

Immigration laws are the only laws that are discussed almost entirely in terms of what can be done to help those who have broken the law.” -Thomas Sowell

Along with Obama’s propensity for lawless unilateral actions and a lot of loose talk hinting at amnesty for illegal aliens, from the Obama administration’s first days, his recent response to the assault on our southern border by tens of thousands of illegal aliens shows that Obama, Eric Holder, Jeh Johnson and a litany of other Democratic Progressives know no bounds, when it comes to betraying America. At every critical juncture during this ongoing crisis, the Obama administration’s intent, purpose and agenda have aligned with the desires of the illegal aliens and their advocates, which makes this administration the most dangerous existential threat to America and Her people in American history.

Remember when Obama admitted he didn’t have the authority to pass the dream Act on his own and then two weeks later still arbitrarily and capriciously issued an executive order implementing it?

Many Progressives will caustically harangue anyone who equates the Dream Act (DACA), signed into law June 15, 2012, with amnesty. They often ask, “Where does it (the DACA) say “amnesty”? It doesn’t, but everything within it certainly embodies the very definition of amnesty: Legal definition – 2. An Amnesty is either expressed or implied; it is expressed when declared in direct terms; and it is implied, when a treaty of peace is made between contending parties.

Now it is apparent that more amnesty is forthcoming. Obama and Eric Holder’s Justice Department are attempting to efface the illegal aliens’ crimes by spending $2 million and providing them with 100 lawyers and paralegals, at taxpayer expense; however, this is in direct violation of Federal immigration law 1229a (b/4/A), which clearly allows illegal aliens to be represented at their own expense, not at the expense of the government.

“Reports from ICE officers and agents on the ground corroborate reports that the majority are motivated more by rumors of amnesty than the situation in their home countries,” stated Chris Crane, president of National ICE Council 118 of the American Federation of Government Employees. Crane added, “Impoverished countries don’t read our laws or read cut-off dates.”

In a startling move, the Obama administration also has promised to reward those Central American nations that are unloading the unaccompanied children (UAC) and other illegal aliens on us, by sending them more money. Obama wants $161.5 million sent to the so-called Central American Regional Security Initiative and nearly $100 million to El Salvador, Guatemala and Honduras. Essentially, these payments are additional incentives for them to do nothing to correct their current situation.

Reuters previously reported that the administration was seeking $2 billion for the Department of Health and Human Services to handle the influx of illegal aliens in fiscal 2015, which begins on October 1, 2014. This is more than double the $868 million appropriated this year.

The U.S. taxpayer is also paying for the new illegal alien children’s facility now opening in Tucson, Arizona. This is the 17th such facility operated by Southwest Key, with an annual budget of more than $150 million that is heavily supported by government contracts, according to KVOA, an NBC affiliate. And, incredibly or unbelievably, the chairman of Southwest Key’s board of directors, Victor Garza, is an official of LaRaza, which hopes to reclaim the Southwest for Mexico.

On June 5th, 2014 (and proudly displayed on DHS homepage) Homeland Secretary Jeh Johnson exclaimed after a verbal jab at Republicans, “Almost all of us agree a child who crossed our border illegally with a parent, or in search of a parent or a better life…should be treated differently than adult law breakers.” Two weeks later, after the surge of illegals made front-page news across the country, the administration started reversing its previous pro-amnesty messaging. But, VP Joe Biden seems to have other ideas, and he recently implied publicly that some of these illegal aliens would not be deported.

There is literally nothing in America’s interest in the entire mission statement of the Office of Refugee Resettlement (ORR), which is now handling “unaccompanied children” (most are adults) and delivering them to shelters located throughout the United States. “Resettlement”, in other words, means these illegals are staying, at least if Obama has his way. According to the UAC services webpage of the ORR, their mission is to assist these illegal aliens “in becoming integrated members of our global society” – not our “American” society.

Also, as reported in the June 25th Congressional hearing titled “An Administration-Made Disaster…,”** the sheer numbers in the cascading flood of illegal immigrants and the associated health and public safety risks should preclude any consideration of legalization or naturalization for these illegal aliens. There have already been numerous positive tests within their ranks for tuberculosis and H1N1, swine flu.

When, ever, did Americans vote for this?

Members of both parties, mainly RINOs and Progressives such as Senator Alexander (R-TN) and Senator Schumer (D-NY), have supported de facto open borders for decades; however, one true conservative, President Ronald Reagan granted amnesty in 1986 against his own better judgment, on the advice of advisors. Then in a series of memos issued after the 1996 Illegal Immigration Reform and Responsibility Act, a law that sought to curtail illegal immigration, officials in both the Clinton and Bush administrations established guidelines and limits for when authorities could exercise leniency in dealing with illegal aliens. And if these years proved anything, America learned that any hint of amnesty always catalyzes illegal immigration.

A normal government would halt these illegal aliens, the drug mules entering with the UACs (documented) and violent interventions by the Mexican military helicopters directed against plainly marked U.S. Border Patrol vehicles, as it worked to halt the other dire threats to public health and safety. A normal government would be mobilizing deportation efforts immediately and returning these illegal aliens to their home countries, which would be less costly than keeping them here in the U.S.

Granting amnesty to illegal immigrants in a welfare state, such as ours, is an economic disaster of epic proportions. The U.S. is over $17 trillion in debt right now. Adding 11-30 million people into our entitlement programs would be devastating to our economy.

Ever willing to knock America down a notch, to weaken America and make Her less prosperous, Obama has announced repeatedly his egregious intent to sign an executive order granting amnesty to this massive swarm of illegal aliens. Rather than send these Central American nations sizable bills for the cost of transporting these children back, he chooses to hit the U.S. taxpayer for the cost of their day care and health care. Obama is openly breaking U.S. law, as he continues with his flagrant executive overreach of power, and Republicans must immediately use their power of the purse to deny funding for Obama’s immigration machinations, or accept their own role in the Death of America.

HEARING: AN ADMINISTRATION MADE DISASTER: THE SOUTH TEXAS BORDER SURGE OF UNACCOMPANIED ALIEN MINORS

By THE HONORABLE BOB GOODLATTE

Jun 25 2014

Judiciary Committee

There is a tsunami hitting our nation’s southern border – unaccompanied alien minors (UAMs) and adults traveling with minors are arriving in unprecedented numbers. Central American minors, largely teenagers, are making a perilous journey through Mexico and then walking miles across a hostile border environment, assisted by smugglers, and coming to the United States in violation of the law.

According to Deputy Border Patrol Chief, Ronald Vitiello, who will testify today, the Department of Homeland Security expects to apprehend more than 90,000 unaccompanied minors on the border this year.  The estimated number of “UAMs” apprehended in 2014 represents a 1,381% increase since 2011, while the projected number of 142,000 apprehensions in 2015 represents a 2,232% increase.  It is not just UAMs who are arriving – adults bringing along minors are also coming. Since 2011 the number of apprehended individuals comprising family units has increased from 13,600 to 42,000 for this year as of June 16th.  Taking into account just half of this year, we have seen a 143% increase in families apprehended at the border since 2012.

The Administration claims that these unlawful aliens are coming to the U.S. based upon generalized violence, strife, conflict, and discord in their home countries. It is true that these factors have always played a role in Central Americans coming to the U.S. illegally.

Undoubtedly, seeing strife in economically disadvantaged countries along with seeing impoverished women and children showing up at our nation’s door step arouses the deepest of sympathies.   However, the factors causing the recent and unprecedented surge are very different than those claimed by the Administration.

A May 28, 2014, Rio Grande Valley (RGV) Sector Intelligence Report tells a story that is strikingly different than the claimed humanitarian crisis the Administration paints as responsible for the surge.  The report summarized interviews conducted with hundreds of apprehended Central Americans minors and quite frankly paints a very different picture of the situation.

According to the report, when these individuals were asked why they made the journey to the United States, approximately 95% indicated that the main reason was to take advantage of the “new” U.S. “law” that grants a “free pass” or permit (referred to as “permisos”) being issued by the U.S. government to women traveling with minors and unaccompanied alien minors. While no new law has been enacted, the truth is that this Administration has dramatically altered immigration enforcement policies.  The timing of the change in policies correlates closely with the steep uptick of individuals showing up at the border.  Apparently, word has gotten out that once encountered by Border Patrol agents and processed, thanks to this Administration’s lax enforcement policies, one will likely never be removed.

Word has spread to the Americas and beyond that the Obama Administration has taken unprecedented, and most likely unconstitutional, steps in order to shut down the enforcement of our immigration laws for millions of unlawful and criminal aliens not considered high enough “priorities,” especially minors and adults with minors.  The world seems to know that DHS refuses to enforce the law under the guise of “prosecutorial discretion.” The beneficiaries of these policies even include many thousands of aliens who have been arrested by state and local law enforcement or convicted criminals who have been put in removal proceedings and who DHS has simply let back onto our streets.

And now those beneficiaries include those minors and families who continue to arrive at our border and the Administration ushers in via “100% reverse escorts” into the interior of the United States.  Most are ultimately released, often into the hands of those who paid smugglers to bring them here in the first place.

In addition to simply not pursuing removable aliens, DHS has been granting hundreds of thousands of these individuals administrative legalization and work authorization.  DHS does this under many guises, invoking doctrines with esoteric names such as “deferred action” and “parole-in-place”. The net effect of these policies has been described by former ICE Acting Director John Sandweg — “If you are a run-of-the mill immigrant here illegally, your odds of getting deported are close to zero . . . .”  Apparently, those arriving at our borders now know this.

Indeed, Father Heyman Vazquez, the director of a migrant shelter in Mexico, told news outlets that children and families are encouraged to cross into the U.S. illegally because they think they will be given amnesty. Vazquez said, “I remember a little boy of 9 years old and I asked if he was going to go meet someone and he told me ‘No, I’m just going to hand myself over because I hear they help kids.'” In addition, like so many others across Central America, Robin Tulio, a 13-year-old, said his mother believed that the Obama Administration had quietly changed its policy regarding unaccompanied minors, and that if he made it across, he would have a better shot at staying. In the meantime, Central American media touts an open door to the U.S. for minors and families.

Based on information the Committee has received, it seems that the Administration has known about this problem for some time.  Rev. Richard Ryscavage, who serves on the White House immigration advisory panel, agrees.  He stated that “Officials hid the fast-growing migration crisis from the media because they’re still trying to pass a very unpopular immigration rewrite.”  He indicated, “That’s the [Administration’s] priority – to get that Senate-type bill passed. They didn’t do anything public about it, they didn’t want to tell anyone about it… [and] they’re now in a stage where they’re feeling ‘We have to figure out a strategy.’” Ryscavage concludes, “That’s what the administration is most afraid of – that [the border surge] will derail any discussion of reform of the immigration laws.”

Unfortunately, these statements show that the Administration has made a fundamental miscalculation.  Its failure to secure our borders, mitigate threats to national security, or enforce our immigration laws only undermines Congress’s ability to reform our immigration laws.

It was easy to predict that people in South and Central America, as well as in Mexico, would recognize a veiled invitation from the Administration to send their children and families to the United States with little chance of deportation.

These individuals know that the Administration’s policy of non-enforcement of our immigration laws presents a golden opportunity for unaccompanied minors and families with minors to come to the U.S., most likely to be released with very little chance of ever being removed.  The Administration’s message is tragic because the journey the Administration encourages is so dangerous and results in death, disease, and harm to so many minors along the way.  It is often said that Nero fiddled while Rome burned.  Unfortunately, it seems Obama fiddles while our borders implode.

I look forward to finding out from the witnesses today what if anything, the Obama Administration plans to do about this crisis and what solutions could work to end it. I’d like to thank all of the witnesses – many of whom are career law enforcement professionals – for taking the time to testify today.

Justin Smith is an awesome political pundit. I am time constrained to fully the intro his post deserves. So I am going to use the intro he gave me in the submission of this essay:

It seems the more things change, the more they remain the same. These marxofascist Progressive devils just will not give up, until they have absolutely destroyed our national security, made us an open-border state and destroyed most of sovereignty through multiculturalist, politically correct class warfare and diversity – no more “melting-pot” or ‘E Pluribus Unum’ for America anymore – only one long abysmal march into the despair that only comes from centralized government and Marxist economic worldviews, unless we fight back like hell and kick them right in the teeth with a good dose of Civil Disobedience (REBELLION -? -)

In regard to U.S. immigration policy and the current flood of illegal aliens into the United States, the only issue one must consider is whether the U.S. is to be a nation governed by the rule of law or by despotism and Obama’s decrees, which do not consider anything other than manipulating the American people and holding power for the marxofascist Progressive Movement, that calls itself “the Democratic Party”. Obama has shown unbelievable temerity, when it involves breaking immigration law, any law for that matter, and his administration has violated the American people’s trust with malice and purposeful, criminal nefarious intent.

In 2013, Obama, Attorney General Holder and the U.S. Immigration and Customs Enforcement released 36,000 criminal aliens into our society, while they awaited deportation. Among these illegal aliens , there were 193 convicted murderers, 426 rapists, 303 kidnappers and thousands of other assault, theft and drug crimes committed, according to the May report from the Center for Immigration Studies.

Just months before the last presidential election, Obama essentially granted amnesty, illegally and unConstitutionally, to 800,000 illegal aliens, through his executive order, the Deferred Action for Childhood Arrivals, which deferred deportation proceedings. This amounted to an open invitation to the people of South and Central America and a sign that they would not be turned away.

The Washington Times noted (6-10-14) that an estimated 10,000 unaccompanied children are being apprehended each month, as they are smuggled into the U.S.; and yet, they are permitted to stay, while military bases in Texas, Arizona and California are overflowing, and another 1200 are being transferred to Ft Sill, Oklahoma. And these are just the ones that have been caught.

In Brownsville, Texas, U.S. District Judge Andrew Hanen details a “criminal conspiracy” from a December 2013 court order, in which illegal alien parents are paying smugglers to bring their children to the U.S., believing amnesty is coming. He focuses on an Obama policy that spends $2 billion U.S. taxpayer dollars to reunite illegal alien children with their illegal alien family, through the Department of Homeland Security. Nobody gets charged with smuggling and nobody gets deported, as the DHS rewards their criminal conduct.

Many immigrants crossing the border in south Texas have been flown to El Paso, to be more easily processed by the Border Patrol. They are then released to be on their way to wherever they choose to go, according to the El Paso Times (6-7-14). One illegal alien, identified only as Maria, said that immigration officials contacted her sister to arrange travel plans, and she is on her way to Tennessee to reunite with her sister.

The humanitarian crisis that has arisen on the southern border is “a crisis of the federal government’s creation, and the fact that the border remains unsecure – now apparently intentionally – while this operation continues full speed ahead is deplorable”, stated Arizona Governor Jan Brewer.

Humanitarian crisis or not, simply reaching the United States’ sovereign territory doesn’t automatically entitle an illegal alien to either amnesty or citizenship, nor should it. Denying U.S. citizenship is not punishment and neither is denying “legal status” for someone, who has already shown an inclination to ignore U.S. law. And, this “crisis” does not demand that the U.S. deliver the minors to the custody of a parent living here illegally, who purposefully chose to leave that child behind years ago; if anything, provision them, the adult they arrived with and the illegal parent for a return trip home, and let them fix their own nation’s problems, since this would be infinitely less costly to our nation in the long term.

Many of the conditions these illegal aliens are attempting to escape, such as the “abuse and persecution” mentioned by White House spokesperson Josh Earnest and the “corruption, poverty and violence” referred to by Santa Cruz (Arizona) Sheriff Tony Estrada, are of their own making. They accepted the Che Guevara, Chavez and Ortega brand of Latin American Marxism and class warfare – the same type of class warfare that Obama and the Progressives are instigating across America – the same type of cradle-to-grave government control that always ends in abysmal failure and poverty for all.

In May, Obama stated that he would act in August, illegally and unConstitutionally once more, to “make law” and comprehensive immigration reform, through an executive order, if Congress did not act soon. Should Obama follow through on this threat, every man, woman and youth, who value Freedom in America, should take to the streets in mass civil disobedience and protest.

Why would we want to bring these sort of influences and worldviews into the country? Any right thinking, logical minded American doesn’t choose this. But Obama does, because Central and South Americans typically vote Democratic and “legalizing” them will ensure the marxofascist Democratic Party’s lock on power for the rest of the century.

When Arizona Governor Jan Brewer complained angrily about the feds dumping illegal aliens from Texas into her state, without any warning, federal officials told her that this will be ongoing for the foreseeable future, as 1000 more illegal immigrant children were scheduled to arrive within days. Adults and family groups will also arrive.

“This is not a humanitarian crisis. It is a predictable, orchestrated and contrived assault on the compassionate side of Americans by her political leaders that knowingly puts minor illegal alien children at risk for purely political purposes”, asserts the statement by the National Association of Former Border Patrol Officers.

Senator Jeff Sessions (R-Ala), after warning for many years that Obama’s immigration policy was certain to create just such a crisis, recently stated: “President Obama is responsible for this calamity…Only by declaring our border is no longer open – that the law will be restored – can this emergency be stopped.”

Republicans must stop falling for Progressive gambits and ploys presented through a myriad of fallacious postulates, such as the immediate need for new “comprehensive immigration reform”. The only real solution for repairing our so-called “broken immigration system” is to enforce current immigration law and secure the border now.

Unless We the People – the American people – have become as corrupt as this Obama administration, we must stand now against this criminal exploitation of Central American children and this political deception. We must stand against those political leaders who are for “a path to citizenship” and amnesty for illegal aliens, before fully protecting our national security (jobs and economy) and public safety (the right of people to be secure in their property and person). For if we fail to stand against the tyrants in DC, we will be committing national suicide, and America, as we knew it (B.O. – “Before Obama”), will disappear forever, remade in the image of the newly arrived and the miserable countries of their origin.

ICE Provides Pocket Amnesty for Illegal Aliens

Morton Memos

Read the John Morton memo written as a matter to prioritize enforce of the law relating to illegal aliens in America:

In light of the large number of administrative violations the agency is charged with addressing and the limited enforcement resources the agency has available, ICE must prioritize the use of its enforcement personnel, detention space, and removal resources to ensure that the removals the agency does conduct promote the agency’s highest enforcement priorities, namely national security, public safety, and border security. (Reading the Morton Memo: Federal Priorities and Prosecutorial Discretion; By Shoba Sivaprasad Wadhia; Immigration Policy Center; December 2010; Introduction)

For Liberals the Morton Memo enables Immigration and Customs Enforcement (ICE) to demonstrate mercy in deporting illegal aliens if they sneaked in and managed to hang around for awhile, produce some anchor babies and/or hang around aliens that have become citizens via the legal path or have legal resident documentation. Thus ICE is to concentrate on illegal aliens that have demonstrated the action of violent crimes. That sounds all altruistic, warm and fuzzy – right?

For Conservatives the Morton Memo is an open door with a sign that might say – “Welcome to America all ye illegal aliens” that desire to flood the American system of government with taxpayer supported free education, medicine and welfare. AND if you happen to break a minor law such as speeding or driving without insurance or working illegally while not paying the same taxes American citizens pay you get a pass because Liberals thinking altruistically wants to make sure the illegal undocumented crowd is well taken care of. After all Hispanic-Americans are the largest growing segment of Americans that prefer another culture rather than the culture handed down by America’s Founding Fathers.

What happened to American cultural solidarity with E Pluribus Unum – Out of the many, ONE?

The Federation for American Immigration Reform (FAIR) has a post explaining the reasons why the Morton Memos are bad immigration policy.
